These Terms of Use (these “Terms”) describe the terms under which we provide the Re-website.com website and our associated products and services (the “Site”).  By clicking on “I agree” or otherwise accepting these terms, or by visiting the Site, you agree to these terms.

In these Terms, words like “we,” “us” and “our” refer to RE:imagine, Incorporated, a Delaware corporation, and words like “you” and “your” refer to individuals who visit the Site.

You should review these Terms in connection with our Privacy Policy, which is available at https://re-website.com/pages/privacy-policy.

We may update these Terms from time to time.  When we do so, we will update the date shown above.  By continuing to use the Site after such date, you agree to the updated version of these Terms.

 

Store

The Site contains an online store that gives you the ability to purchase various goods. Purchases through the store are subject to our shipping and return policies, which can be viewed through links available in the website footer (the “Shipping and Return Policies”).  Our only warranties with regard to products sold through the store are made in the Shipping and Return Policies. 

The store is powered by Shopify and purchases are subject to Shopify’s terms of service, which are available at https://www.shopify.com/legal/terms 

 

Community

The RE—Space Community (the “Community”) is a social community that we offer through the Site on a subscription basis.  The Community is not intended for use by people under the age of 18, and if we discover that a person under age 18 has subscribed to the Community, we may terminate their subscription without refund.  Additional terms for the Community are available at https://membership.re-website.com/term

We may, from time to time, adopt and modify policies regarding the acceptable use of the Community and restrictions on information or content that may be posted to the Community.  If we determine that any member has violated these policies, then we may, in our discretion, terminate that member’s membership in the Community without refund.

By posting material to the Community or by using the Community’s messaging features, you warrant that the material you provide does not infringe any copyright or other intellectual property rights of any third party and agree to indemnify, defend and hold us harmless from and against any claim brought by a third party arising from material that you upload.

We may monitor and review communications made through the Community, including one-on-one communications and may, in our discretion, remove any material posted by any user in the Community for any reason.  We may disclose communications to law enforcement agencies if we believe that doing so is legally required or is appropriate to protect the physical or mental health or safety of any person.

We do not promise that the Community will work as intended or that any information or material you post to the Community will be available only to the intended recipients.  Further, we cannot control what other Community members do with the information you provide.  Correspondingly, you should not post any information to the Community that you do not want to be public.

We do not control, and are not responsible for, information or content posted by members of the Community.  If you believe somebody has posted illegal, defamatory, or infringing content, please email us using the contact information below.  We cannot, however, promise that we will respond to every email.

The Community is available on either a monthly or annual subscription basis, and the subscription payment will automatically renew at the end of the then-current term under the current terms unless you terminate your membership before the monthly or annual renewal.  If you are unable to terminate your membership through the Site, then please email us at membership@re-email.com 

 

Ownership and Restrictions on Use

The Site is owned by us and by people and companies who have licensed their rights in certain content on the Site to us.  We, and those licensors, reserve all rights to the Site.  You may not duplicate, republish, translate, or publicly display the Site, in whole or in part, or use any sort of “bot” or automated means to scrape information or content from the Site without our consent.  In particular, you may not use the content of the Site to train any artificial intelligence model.

 

Disclaimers and Limitation of Liability

The Site is intended for general information purposes only.  We do not promise that the Site will function correctly, that it will be available at any particular time or that the information shown on the Site will be current, reliable, complete, or correct.  We do not promise that the Site will function on your computer or mobile device.  Although we try to keep the Site free of security vulnerabilities, computer viruses, or other types of “malware,” we do not guarantee that the Site will be free of malware.  We may change the contents or organization of the Site at any time.  THE SITE IS PROVIDED WITHOUT WARRANTY OF ANY KIND, AND WE DISCLAIM ALL IMPLIED WARRANTIES. IN PARTICULAR, WE DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTAIBILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.  WE DISCLAIM ALL LIABILITY ARISING FROM YOUR USE OF THE SITE.

IN NO EVENT WILL WE BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, OR PUNUTIVE DAMAGES ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SITE, AND, EXCEPT AS PROVIDED IN OUR RETURN POLICY, IN NO EVENT WILL OUR LIAIBLITY TO YOU ARISING FROM OR IN CONNECTION WITH THE WEBSITE OR THE COMMUNITY EXCEED FIFTY DOLLARS ($50).

 

Links to Third-Party Websites

The Site may contain links to material located at websites operated by third parties. We are not responsible for the content of any material stored on those other websites or for any material provided by those third parties.  We do not monitor any such material to be sure that it has not changed.  You visit those websites at your own risk.  We do not guarantee that any link to any external content will continue to work.

 

Feedback

If you submit questions, proposals, comments, feedback, suggestions for revisions to the Site, or suggestions for products which you believe we should offer (collectively, “Feedback”) then, by doing so, you are granting us a worldwide, perpetual and irrevocable license to use such Feedback (and to allow others to use Feedback) for any purposes and in any manner we choose without any compensation acknowledgement to you.  Further, we do not promise to keep Feedback confidential.

 

Governing Law and Disputes

These Terms, and your use of the Site, are governed by California (USA) substantive law.  If any dispute or claim arises in connection with your use of the Site, then you must bring such claim exclusively in the state and federal courts located in Los Angeles County, California, and you agree to the personal jurisdiction of such courts.
